Service agreement
Version of 30 October 2026
This agreement is between you (the client) and ClaimSahayak, and applies to the case you register with us. Please read it before you pay. It sits alongside our Terms of Use and Privacy Policy.
1. What we do
We review your rejected or short-paid claim and, where suitable, prepare and pursue complaints for you with the insurer's grievance officer, IRDAI Bima Bharosa and the Insurance Ombudsman. A consumer commission case is taken up only if you choose that option when we offer it. We cannot guarantee any result.
2. Registration fee
- You pay ₹499 when you register the case.
- If, after reviewing your documents, we decide not to take up your case, we refund ₹400 and keep ₹99 for the review.
- If we take up your case, the ₹499 is adjusted against the success fee.
3. Success fee
- 15% of the Amount Received, if the money is received at the insurer, Bima Bharosa or Ombudsman stage.
- 18% of the Amount Received, if the money is received after a consumer commission case is filed through us.
- GST at the applicable rate is added once ClaimSahayak is registered for GST.
- No success fee is payable if no money is received because of our work.
4. What counts as the Amount Received
The money the insurer pays (or agrees in writing to pay) on the claim after you register with us, including any interest or compensation awarded, minus any amount the insurer had already paid or offered in writing before you registered. If the claim is paid in parts, the fee is worked out on each part as it is received.
5. Telling us and paying
- Please tell us within 3 days when you receive an award, a settlement letter or the money, and share a copy of the letter or the bank entry.
- We will put the bill on your case page and email it to you.
- Please pay within 7 days of the money reaching your bank, online through the website.
6. If you withdraw or settle directly
You may stop the case at any time by writing to us. But if, after we have sent a complaint or representation on your behalf, you withdraw the case or settle directly with the insurer, and the claim is later paid in full or in part, the success fee is still payable on the Amount Received.
7. If the fee is not paid
We will first send reminders. If the fee is still not paid, we may send a legal notice and recover it under this agreement.
8. Disputes
We will first try to settle any dispute by talking for 30 days. If that does not work, it will be decided by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Jabalpur, in Hindi or English. This does not take away your rights under the Consumer Protection Act, 2019.
9. How you accept
You accept this agreement by ticking the box and pressing Accept on your case page while logged in with the one-time code sent to your email. We record the date, time and version. The Hindi text is a translation; if the two differ, the English text applies.
